How a backyard home gets paid for changed in July 2026
The 21st Century ROAD to Housing Act was enacted on 11 July 2026. It added ADU construction to a federal loan program that did not cover it, and expanded lending that sits behind your existing mortgage instead of replacing it. Below is each provision, in the authority record’s own words, with its caveats.

Is there a federal loan that will actually pay to build a backyard unit?

The ROAD Act (Pub. L. 119-101, enacted 2026-07-11) adds ADU construction as an eligible use of FHA Title I property-improvement loans and raises the loan limits / lengthens the terms. This is FINANCING ELIGIBILITY, not a tax credit. NOTE: for ADU construction the statute sets the loan amount at "such principal amount as the Secretary may prescribe" — HUD has NOT yet prescribed it, and as of 2026-08-13 HUD has issued no Title I letter implementing §303 (the Title I letter series ends at TI-488, March 2024, which covers manufactured-home limits only). So ADU eligibility is ENACTED BUT NOT YET OPERATIONAL: authorized is not the same as available, and no lender can originate a Title I ADU loan until HUD sets the amount and issues guidance.
This is the provision the ROAD Act changed, and most originators have not built a product for it yet.

My income is modest. Is there a cheaper version of this for me?

To be eligible as a HomeReady mortgage, "the total annual qualifying income may not exceed 80% of the AMI for the property's location" (Fannie Mae Selling Guide B5-6-01). Freddie Mac Home Possible applies the same 80% area-median-income ceiling. These are not separate ADU programmes: they are income-qualified versions of conventional mortgages, and HomeReady may be combined with HomeStyle Renovation (as Home Possible may with CHOICERenovation) to fund ADU construction, so a borrower at or below 80% AMI reaches the SAME renovation product on lower-cost terms. ⚠ TWO CONDITIONS A BORROWER MUST CHECK RATHER THAN ASSUME. First, using HomeStyle Renovation together with HomeReady requires that the LENDER be specifically approved by Fannie Mae to originate HomeStyle Renovation loans, so a lender offering one may not offer the combination. Second, rental income from an ADU on a 1-unit primary residence may be used to qualify but "cannot exceed 30% of the income used to qualify the borrower". ⚠ THE AMI FIGURE THAT DECIDES IS THE ONE THE AGENCY PUBLISHES, not a general area statistic: Fannie and Freddie each publish limits by location and a lender applies those. Any median-income figure shown alongside this provision is a reference point, not the qualifying threshold.
At or below 80% of area median it is the same renovation mortgage on better terms, not a different product to go looking for. ⚠ Two conditions decide it in practice: the lender must be separately approved to originate HomeStyle Renovation, and ADU rent counted toward qualifying is capped at 30% of qualifying income.

Do I have to give up my low mortgage rate to build one?

Is there grant money for a town that wants pre-approved ADU designs?

ROAD Act §209 authorizes competitive grants for pre-approved ADU designs (10% rural set-aside). NOTE: grant funding is APPROPRIATIONS-DEPENDENT — availability follows annual appropriations, so it is authorized but not guaranteed.

What about the conventional renovation loans that already existed?

Can the rent from the unit help me qualify for the loan?

Projected rental income from ONE ADU on a 1-unit primary residence may be used to qualify the borrower, capped at 30% of qualifying income (Fannie Mae Selling Guide SEL-2025-08, Oct 8 2025; DU v12.1 ~Mar 2026). The 30% is a qualifying cap — NOT a tax credit.

A USDA Single-Family Housing Guaranteed Loan proposed rule (Federal Register, Mar 31 2026) would allow financing an income-producing ADU. PROPOSED — NOT FINAL; do not rely on it until finalized (surfaced as flagged/advisory).

Why do you show a caveat on the grant program?
